18.20.010 Temporary and portable structures.

(1) Approval. A temporary or portable structure may not be constructed or placed upon real property without approval by the City, unless such approval is not required under the Oregon Building Code, Albany Development Code, and Oregon Fire Code. The City’s approval shall:

(a) Specify the duration of time during which the structure may be sited, used, or occupied, not to exceed 180 days;

(b) Specify the approved use and occupancy class of the structure;

(c) Ensure compliance with the aforementioned codes; and

(d) Be site-specific and the temporary structure shall not be relocated to any other site or location within the site without a new approval having been obtained.

(2) Connections. Temporary or portable structures shall not be permanently connected to any utilities. All utility connections shall be disconnected and removed immediately upon removal of the structure or expiration of the placement approval. The building official shall require water and sanitation facilities when necessary for public health considerations.

(3) Placement. Temporary or portable structures shall not be placed in parking lots, required setbacks, fire separation areas, easements, or areas not specifically approved for such use.

Portable structures shall not be used in place of permanent structures unless said structure complies with the applicable requirements specified in the Oregon Building Code, Albany Development Code, and the Oregon Fire Code and permitted and inspected as a permanent structure.
