History of the Albany Municipal Code: The Albany Municipal Code, as compiled from the ordinances of the City, was adopted as the Code for the City of Albany, Oregon, in 1970. In 1993, the Code was revised, reformatted and reprinted by Code Publishing Company. The 1993 revision brings the Code up to date through Ordinance 5059, passed July 14, 1993. The Code includes all ordinances of a general, permanent, or public nature, or those imposing a fine, penalty, or forfeiture.

Numbering system: Titles, chapters, and sections are organized generally by subject matter. The number of each section of this Code consists of three parts, in sequence as follows: Number of title; number of chapter within the title; number of section within the chapter. Thus Section 7.08.020 is Title 7, chapter 8, section 20. The section part of the number (.020) initially consists of three digits. This provides a facility for numbering new sections to be inserted between existing sections already consecutively numbered. In most chapters of the Code, sections have been numbered by tens (.010, .020, .030, .040, etc.), leaving nine vacant numbers between original sections so that for a time new sections may be inserted without extension of the section number beyond three digits.

Legislation: The legislative source of each section is enclosed in parentheses ( ) at the end of the section. References to ordinances are abbreviated; thus “(Ord. 4884 § 1, 1989; Ord. 3404 § 3, 1969)” refers to section 1 of Ordinance No. 4884 and section 3 of Ordinance No. 3404. A semicolon between ordinance citations indicates an amendment of the earlier ordinance.

Codification tables: To convert an ordinance citation to its Code section number consult the codification tables. Tables at the end of the Code list all codified ordinances. Ordinances included in the Code indicate where they are located. Ordinances designated “Special” (e.g., tax levy, annual budget, salaries) are not included in the Code.

Index: Titles 1 through 20 are indexed in the subject matter Index located at the end of the Code. The index includes complete cross-referencing and is keyed to the section numbers described above. A separate index for the Charter follows the Charter.

HOW TO AMEND THE CODE

Code Structure and Organization

The Code is organized using a 3-factor decimal numbering system which allows for additions between sections, chapters, and titles, without disturbing existing numbers. Typically, there are 9 vacant positions between sections and several vacant positions between chapters.

Ordinances of a general or public nature, or one imposing a fine, penalty or forfeiture, are codifiable. Prior to enacting a codifiable ordinance, ascertain whether the Code already contains provisions on the topic.

Additions

If the proposed ordinance will add material not contained in the Code, the ordinance will specify an “addition”; that is, a new chapter (or title) will be added. For example:

Section 1. Chapter 5.20, Taxicab Licenses, is added to read as follows:

Amendments

If the ordinance amends existing Code provisions, specify the affected section or chapter numbers in the ordinance. This kind of amendment typically adds a section to an existing chapter, or amends an existing section. For example:

Repeals

Ordinances which repeal codified material should specify the Code section number (or chapter number if an entire chapter is being repealed). These section or chapter numbers will be retained in the Code, along with their title, as a record of ordinance activity (and as an explanation for gaps in the numbering sequence). The number of the repealed section or chapter number can be reused at a later time when desired. For example:

Section 2. Section 5.05.020, License, is repealed.
